Isso é óbvio. Mas algumas pessoas mal-intencionadas tentaram, no tapetão, passar por cima da lei e da Justiça brasileiras, acreditando que isso se daria impunemente. Ficamos preocupados com os atletas e tentamos advertir para ilegalidade e insustentabilidade desse terrorismo. Muita gente, contudo, se deixou enganar por esses "rábulas" em causa própria.<br /><br /></div> <div style="LINE-HEIGHT: 150%; MARGIN-BOTTOM: 0cm" class="western" align="justify"> </div> <div style="LINE-HEIGHT: 150%; MARGIN-BOTTOM: 0cm" class="western" align="justify">O evento da inexistente Federação Paulista de ??? teve o intento de criar cizânia e confusão e nos impedir de realizar nosso Campeonato (o que de fato eles conseguiram, com o recuo, na última hora, da Universidade Anhembi, que suspendeu a cessão do Teatro da Vila Olímpia até então agendado). Reginaldo Gomes, está em pleno vigor, não tendo qualquer efeito legal a tentativa da IFBB de descumpri-la.</div> <div style="LINE-HEIGHT: 150%; MARGIN-BOTTOM: 0cm" class="western" align="justify"> </div> <div style="LINE-HEIGHT: 150%; MARGIN-BOTTOM: 0cm" class="western" align="justify">Desta vez, para coibir novas ilegalidades, fixou multa aos Réus por cada ato de desrespeito à decisão. Reginaldo Gomes, desta feita de 04 (quatro) anos, esta imposta quando o mesmo voltou ao exercício da Presidência da CBC-M.</p><p>Tanto que a nota se apresenta como falaciosa que somente informa a imposição de nova suspensão, sem, entretanto, apresentar uma justificativa razoável para o alegado, sem se falar de que o principal interessado em tomar conhecimento do fato, que é o Sr. Reginaldo Gomes, não foi de nada informado até a presente data.</p><p>A nota faz menção a comunicado do Sr. Reginaldo Gomes de que a Federação Paulista não é afiliada à CBC-M,comprova o afirmado.</p><p>Para que uma Federação venha a ser considerada filiada à CBC-M, não basta que ela efetue o pedido e este seja deferido pelo presidente (?), conforme ocorreu com a Federação Paulista. É necessário que este pedido seja levado à apreciação da Assembléia Geral e esta sim é que tem poderes para homologar o pedido de filiação. No caso da Federação Paulista, como é sabido por todos, tal não aconteceu.</p><p>Não consta da ata de Assembléia realizada naquela oportunidade ter sido apreciado e votado tal pedido. Assim, por força do disposto no estatuto da CBC-M, a Federação Paulista realmente não é filiada a esta Confederação.</p><p>No que diz respeito a alega chancela pela IFBB do Campeonato Paulista realizado por tal federação nos dias 18 e 19 de junho, não passa de mais um engodo para tentar impressionar e pressionar os desavisados.</p><p>A IFBB não tem qualquer ingerência na realização do Campeonato Paulista, por tratar-se de evento estritamente sob a responsabilidade da CBC-M. Logo, a IFBB não pode chancelar algo da qual ela não tenha competência.</p><p>Da mesma forma, a IFBB não tem poderes ilimitados, isto é, não esta aquela instituição acima das decisões judiciais aqui proferidas. Ao contrário, obrigada a acatar as decisões judiciais, assim como Srs. Maurício e Bruno.</p><p>Isto significa dizer que a alegada segunda suspensão imposta ao Sr. Reginaldo Gomes nenhuma efetivada possuiu. Nem mesmo argumento de que a suspensão fora imposta por outro motivo pode ser utilizado como motivo para deixar de cumprir a ordem judicial.</p><p>Assim, enquanto perdurar a ordem liminar concedida, o Sr. Reginaldo Gomes está sim exercendo de forma efetiva a presidência da CBC-M.</p><p>Maurício como pretende fazer crer a nota da Federação Paulista.</p><p>O argumento de que a liminar concedida ao Sr. Reginaldo Gomes seja provisória também é falaciosa. A liminar é clara quanto a sua finalidade.</p><p>Imediata recondução do Sr. Reginaldo Gomes à presidência da Confederação Brasileira de Culturismo e Musculação (CBC-M).</p><p>DESTA FORMA, OS COMUNICADOS DA CBC-M sobre a realização do Campeonato Paulista nos dias 25 e 26 de junho são válidos e classificarão os atletas para o Campeonato Brasileiro, até porque não se pode validar um</p><p>campeonato realizado por uma entidade não federada.</p><p>Enquanto vigente a liminar concedida, que diga-se , já foi objeto de duas tentativas visando derrubar a sua validade, inclusive junto ao Tribunal de Justiça de São Paulo, não se pode falar em impedimento do Sr. Reginaldo Gomes no cargo de presidente da CBC-M.</p><p>Não é mero argumento, sem qualquer fundamentação legal, de que existe nova suspensão por parte da IFBB que serve para retirar a validade da liminar concedida. A Justiça está acima da vontade dos “poderosos” Sr. Maurício Arruda e Bruno Coraucci, e a justiça mantém o Sr. Reginaldo no cargo de onde jamais deveria ter saído.</p><p>Não existe nova penalidade, ainda que supostamente proferida por quem não possuiu aptidão legal sobre as decisões judiciais em nosso país.</p><p> </p><p>DIANTE DO EXPOSTO, O SR. REGINALDO GOMES NÃO SÓ DETÉM LEGITIMIDADE PARA ATUAR EM NOME DA CBCM, COMO VÁLIDOS SÃO TODOS OS SEUS ATOS PRATICADOS, INCLUSIVE EVENTOS, CONTRATAÇÕES E DE MAIS DECISÕES QUE PROFERIR, NULOS, NA VERDADE, SÃO OS ATOS QUE O SR. MAURÍCIO E BRUNO EVENTUALMENTE ESTEJAM PRATICANDO EM NOME DA CBCM, PORQUE ESTES JÁ ESTÃO CIENTES DA LIMINAR CONCEDIDA AO SR.
